Auction Terms

Auction end dates for most fixtures, equipment and display case items will end in the last week of September 2025, and will then be available for pickup only in the first two weeks of October.

Representation Waiver. All Items are offered for sale “as-is, where-is”. My Favorite Things, LLC (MFT) makes no representation of any kind as to the fitness for any purpose of the items offered for sale.

Inspection. Most items’ condition are used/second-hand, thus may have blemishes not immediately obvious. Prior to placing a bid, Bidders may inspect items at the MFT Store location in Post Falls, ID during MFT business hours.

Bidding. Be advised, a Bid on an item is the same as a contract. Only bid on item(s) you are serious about buying. If yours is the winning bid, you are legally bound by contract to purchase the item(s).

Proxy Bidding (also known as Automatic Bidding). In this bidding process, the system will place automatic bids on behalf of Bidders so you don’t have to keep coming back to re-bid every time another Bidder places another bid. When a Bidder places a Proxy Bid, you enter the maximum amount you are willing to pay for the item. The seller and other Bidders don’t know your maximum bid. The system places bids calculated from the automatic bid increment amount and the current high bid – and will bid only as high as necessary to make sure that you remain the high bidder, or to meet the reserve price, up to your maximum amount bid. Should your maximum bid no longer be a winning bid, you will be notified and you have the option to manually re-enter a higher maximum bid.

Consideration. MFT reserves the right to reject any and all bids and to withdraw from sale any of the items listed.

Buy It Now (BIN). MFT reserves the right to change the BIN price of an item while an auction is open. A best effort will be made to notify ( by email ) any Bidders who had placed bids on that item or have the item on a Watch List. An item that is purchased and paid for at the BIN price will be removed from sale, but may not be available for Pickup until after Sept 30, 2025.

Bid Deposits. Some items and/or threshold of aggregate bids placed by Bidder may require a Bid Deposit to ensure fairness to all buyers.

Payment. Successful Bidders will be notified by email with a Notice of Award from MFT Deals, and must make payment on the website within three (3) business days after notification. MFT Deals uses Square to process all credit-card payments and retains no banking specific information. Bidder will be notified upon receipt of payment. No checks or money orders will be accepted.

Sales Tax. Purchase of all items are subject to ID State Sales Tax. MFT will collect sales tax, unless the Buyer has provided a valid tax-exempt certificate to MFT prior to payment.

Pick-up Procedure. Buyer must print out and bring:

the Notice of Award,
the Paid Receipt, and
Photo ID – such as Driver’s License

Removal. Buyer must remove auction items(s) from the MFT Store location in Post Falls, Idaho within ten (10) business days after the time and date of issuance of the Notice of Award.

If the Buyer, after making payment for an item, fails to remove the item within the specified time, MFT reserves the right (1) to retain all payments; and (2) to dispose of the item through another auction or otherwise.

The Buyer is responsible for packing, loading, removing and transporting all items awarded to them from the MFT Store location.

Default. Default shall include (1) failure to observe these terms and conditions; (2) failure to make good and timely payment; or (3) failure to remove all items within the specified time. Default may result in (1) termination of the bid contract; (2) forfeiture of any Bid Deposits; and (3) suspension from participation in all future sales until the default has been cured. If the Buyer fails in the performance of their obligations, My Favorite Things, LLC (MFT) may exercise such rights and may pursue such remedies as are provided by law in the State of Idaho.

Acceptance of Terms and Conditions. By submitting a bid, the Bidder agrees that the Bidder has read, fully understood and accepted these Terms and Conditions, and agrees to pay for and remove the items, if the bid is accepted, by the dates and times specified.
